1.1. These “Terms and Conditions” of the sale for all online courses/ programs and any related digital assets or products, hereinafter known as “Course Content”, sold by Mitigation Information Technologies DBA MITClasses, and its affiliated website rdavidsweet.com (“Website”) and extends to the Buyer and all extended subsequent “Participants”.
1.2. Course Access Period. All courses and Course Content issued, paid or unpaid, from July 1st, 2023 and beyond have a 1-year access period from the purchase date unless specified by MITClasses. Any existing Course Content collected in the course access period has a lifetime access period from the date of purchase and beyond. MITClasses will not renew, update, or deliver content to the Buyer or Participants beyond the course access period. MITClasses retains the right to change the access period for any reason and will notice the Buyer in a reasonable time frame.
1.3. Payment and Refunds. MITClasses does not accept cash, money orders, personal checks, cryptocurrency, or mobile payments with limited adoption. Any deviation from the payment method presented to the Buyer during the checkout process on the Website will need to be documented through an invoice, addendum, or other records. MITClasses retains the right to change payment terms at any time with a reasonable notification to the Buyer. The Buyer is entitled to a refund 3 days after the initial purchase, regardless of the trial period, paid or unpaid, and is addressed on a case-by-case basis after mandatory cancellation feedback is provided. Refunds will not be issued 30 days after the purchase but can be utilized as credit to be used with Mitigation Information Technologies and its products and services. Access to the Course Content, digital asset(s), and/or online course(s) will remain for the duration of the digital access period unless terms and conditions are violated.
1.4. Intellectual Property. All course materials, including but not limited to text, videos, graphics, and any other content provided in the Course Content are the intellectual property of MITClasses. Any unauthorized use, reproduction, or distribution of the Course Content, or any attempt to reverse engineer or create derivative works, is strictly prohibited. The Buyer and any Participants agree to provide appropriate attribution to MITClasses when referencing or sharing content from the Course in any public or private forum. The MITClasses reserves the right to update, modify, or discontinue any aspect of the Course Content, including its structure. Notice of such changes will be provided to The Buyer in a timely manner.
1.5. Code of Conduct.
1.5.1. Respectful Interaction. All participants are expected to engage in respectful and courteous communication. Avoid the use of offensive language, discriminatory remarks, or any form of harassment.
1.5.2. Collaboration and Participation. Foster a collaborative and inclusive learning environment. Contribute constructively to discussions and group activities, respecting diverse opinions and perspectives.
1.5.3. Privacy and Confidentiality. Respect the privacy of others. Refrain from sharing personal information without consent, and do not disclose confidential information shared within the course.
1.5.4. Academic Integrity. Uphold high standards of academic integrity. Avoid plagiarism, cheating, or any form of dishonesty. Properly cite sources and give credit to the original authors when applicable.
1.5.5. Technology Etiquette. Use technology responsibly and for course-related purposes. Avoid disruptive behavior during virtual meetings or discussions.
1.5.6. Timeliness and Commitment. Attend scheduled sessions and submit assignments on time. Communicate in advance if you anticipate any challenges meeting deadlines.
1.5.7. Feedback and Critique. Provide feedback in a constructive and respectful manner. Accept feedback from others graciously and use it as an opportunity for improvements.
1.5.8. Inclusive Language. Use language that is inclusive and considerate of diverse backgrounds and perspectives. Avoid discriminatory or exclusionary language.
1.5.9. Compliance with Course Policies. Adhere to all policies outlined in the course syllabus and terms and conditions. Report any violations of the Code of Conduct to the course instructor.
1.5.10. Consequences of Violations. Violations of the Code of Conduct may result in consequences, including but not limited to warnings, temporary suspension, or permanent removal from the course.
1.6. Disclaimers.
1.6.1. Educational Purpose. MITClasses provides this online course for educational purposes only. The information presented in the course is intended to be general in nature and should not be construed as professional advice.
1.6.2. No Guarantee of Results. While MITClasses strives to provide accurate and up-to-date information, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Course Content for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
1.6.3. Individual Results May Vary. MITClasses does not guarantee specific results or outcomes for individuals participating in the course. The success of each participant depends on various factors, including but not limited to their background, dedication, and application of the course materials.
1.6.4. Professional Advice. It is recommended that participants seek the advice of qualified professionals for any specific concerns or questions related to their personal, financial, legal, or professional situation.
1.6.5. Technical Issues. MITClasses is not responsible for any technical issues or interruptions that may affect access to the Course Content. MITClasses will make reasonable efforts to address and resolve technical issues promptly.
1.6.6. Third-Party Content. The course may include references or links to third-party websites, products, or services. MITClasses is not responsible for the content, availability, or practices of these third-party entities.
1.6.7. Assumption of Risk. Participants acknowledge that their participation in the course is voluntary, and they assume all risks associated with such participation.
1.6.8. Limitation of Liability. To the fullest extent permitted by law, MITClasses shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with the use of the Course Content.
1.6.9. Acceptance of Terms. By enrolling in and accessing the course, participants acknowledge that they have read, understood, and agreed to the terms and disclaimers outlined in this clause.
1.7. Extension of Terms and Conditions to Subsequent Users. By enrolling in and accessing the Course Content by MITClasses, the original Buyer acknowledges and agrees that the terms and conditions outlined herein extend to any persons, users, or Participants who subsequently access or use the Course Content through the original Buyer's account or with their permission. These terms and conditions, including but not limited to the Code of Conduct, intellectual property rights, and any other policies set forth by the MITClasses are binding on all individuals who gain access to the Course Content through the original Buyer. The original Buyer is responsible for ensuring that any persons or users granted access to the Course Content are made aware of and agree to comply with these terms and conditions. Any violation of these terms by subsequent users may result in consequences, including but not limited to warnings, temporary suspension, or permanent removal from the course, as outlined in the Code of Conduct and other relevant policies. By providing access to the Course Content to other individuals, the original Buyer affirms that they have the authority to bind such users to these terms and conditions and accept responsibility for their compliance.
1.8. Technical Requirements Specify any technical requirements for accessing the course, such as internet speed, browser compatibility, or software installations.
1.9. Modifications to the Course MITClasses Reserves the right to update or modify the course(s) content, schedule, or any other aspect of the course, extending to digital assets related to aforementioned course(s). The MITClasses reserves the right to update, modify, or discontinue any aspect of the Course, including its content and structure. Notice of such changes will be provided to students in a timely manner.
1.10. Termination.
1.10.1. Violation of Terms. MITClasses reserves the right to terminate a participant's access to the online course immediately and without prior notice if the participant breaches any of the terms and conditions outlined in this agreement, including but not limited to violations of the Code of Conduct.
1.10.2. Non-Payment. Failure to make payment for the course fees within the specified timeframe may result in termination of access to the course.
1.10.3. Conduct Detrimental to Learning Environment. MITClasses may, at its discretion, terminate a participant's access to the course if their conduct is deemed to be disruptive, disrespectful, or otherwise detrimental to the learning environment, as outlined in the Code of Conduct.
1.10.4. Non-Compliance with Policies. Participants who fail to comply with the policies and guidelines outlined in the course syllabus, as well as any additional policies communicated by MITClasses may face termination from the course.
1.10.5. Refund Policy Violation. MITClasses reserves the right to terminate access to the course if a participant violates the refund policy outlined in the terms and conditions.
1.10.6. No Refund for Termination. In the event of termination, whether initiated by MITClasses or the participant, no refunds for course fees will be provided.
1.10.7. Procedure for Termination. In the event of termination, will notify the participant via email and provide an explanation for the termination. The participant will be required to cease all use of course materials immediately.
1.10.8. Appeals Process. Participants who believe that termination was unjust may submit an appeal in writing to R. David Sweet within 24-48 Hours MITClasses will review the appeal and respond in a timely manner.
1.10.9. Return of Course Materials. Upon termination, participants must promptly return or delete all course materials, including but not limited to documents, videos, and any other content provided as part of the course.
1.10.10. Effect of Termination. Termination of access to the course does not relieve the participant of any obligations or liabilities incurred prior to the termination.
1.10.11. Modification of Terms. MITClasses reserves the right to modify the termination clause and associated policies at any time. Participants will be notified of any such changes.
1.11. Governing Law. In the event of a dispute arising from or relating to the Terms and Conditions, the parties agree that the sole dispute resolution procedure available to them shall be binding arbitration conducted by the American Arbitration Association. The prevailing party in any such dispute resolution proceeding shall be entitled to an award of its attorneys’ fees and costs. The exclusive venue for any dispute resolution proceeding arising from or relating to this Agreement shall be in Hillsborough County, Florida. The Terms and Conditions shall be interpreted and applied in accordance with Florida law. A Party’s failure to enforce a right under this Agreement shall not be deemed a waiver of such Party’s right to enforce that right for any prior or future violation relating to the right.
1.12. Communication. MITClasses will communicate any changes and updates made to the system, website, courses, or Course Content with students through their learning portal, phone, and email provided during checkout or registration.
1.13. Intellectual Property.
1.13.1. Ownership of Course Content. All Course Content and materials, including but not limited to text, videos, graphics, and any other content provided in this online course ("the Course") or Website, are the intellectual property of MITClasses.
1.13.2. License to Participants. Subject to compliance with these terms and conditions, the Owner grants participants a non-exclusive, non-transferable license to access and use the Course solely for personal and educational purposes.
1.13.3. Restrictions on Use. Participants are expressly prohibited from reproducing, distributing, modifying, or selling the Course Content without the explicit written consent of the Owner.
1.13.4. Prohibited Activities. Any unauthorized use, reproduction, or distribution of the Course Content, or any attempt to reverse engineer or create derivative works, is strictly prohibited.
1.13.5. Attribution. Participants agree to provide appropriate attribution to the Owner when referencing or sharing content from the Course in any public or private forum.
1.13.6. User-Generated Content. Any content generated by participants within the Course, such as comments, discussions, or assignments, may be subject to separate terms and conditions. However, the Owner reserves the right to moderate, remove, or use such content as permitted by law.
1.13.7. Duration of License. The license granted to participants is effective for the duration of the Course. Any termination of access to the Course will result in the immediate revocation of the license.
1.13.8. Termination of Access and License. The Owner reserves the right to terminate a participant's access to the Course and revoke the license if there is a violation of these terms and conditions or for any other reason deemed necessary by the Owner.
1.13.9. Infringement Reporting. Participants and Buyers are encouraged to report any suspected infringement of intellectual property rights related to the Course. The Owner will investigate and take appropriate action in response to such reports.
1.13.10. Updates and Modifications. The Owner reserves the right to update, modify, or discontinue any aspect of the Course, including its content and structure. Notice of such changes will be provided to participants in a timely manner.
1.13.11. Non-Disclosure. The Buyer and the participants agree to treat all proprietary information, discussions, and materials shared as confidential. Any unauthorized disclosure or use of such information is strictly prohibited, and violation of these terms will result in removal from the course.
